Dean Hughes, 46, from Church Road from Bickershaw, is currently residing at HMP Risley, after pleading guilty to a section 18 assault regarding the same incident.
Prior to the victim’s death, Hughes received a sentence of 8 years in jail.
The case has been subsequently resubmitted to the Crown Prosecution Service following Maloney's death, with Hughes now charged with murder.
Hughes will appear on Wednesday, October 18 at Wigan and Leigh Magistrates.
